The American people clearly and overwhelmingly support medical marijuana. National polls show that more than three out of four Americans favor its legal medical use. It’s time for our politicians to honor the will of the people. To date 17 states and Washington DC have enacted medical marijuana legislation allowing it’s use. All require a written recommendation from a licensed physician. Because of these laws, thousands of patients are able to alleviate their suffering without fearing arrest by state or local authorities. However, the threat of arrest by federal agents still exists.

The American College of Physicians, The American Nurses Association, American Public Health Association, and many other medical associations support safe and legal access to medical marijuana for patients whose doctors recommend it. • HR 5842 (the medical marijuana patient protection act) will prohibit the Department of Justice from using any funds to interfere with state medical marijuana laws. Against the will of the people in the twelve states which enacted medical marijuana laws, the Department of Justice continues arresting patients and providers and destroying their property in situations where in most cases, federal prosecutors will not even press charges. The best action “we the people” can take on behalf of patients is contacting our elected representatives to let them know we’re in favor of them voting for HR 5842 (the medical marijuana patient protection act).

Another important piece of legislation is HR 5843,(act to: Remove Federal Penalties for the Personal Use of Marijuana by Responsible Adults). Since marijuana accounts for almost half of all drug arrests, this is a huge step in the right direction. About eighty percent of all marijuana arrests are for possession.

Both bills are included in the paragraphs below, which you may copy and send to your representatives. If you only favor one bill, just copy the paragraph pertaining to that bill. Polls of elected officials indicate the most effective methods for getting elected officials to take action in your favor are; (1) a personal visit to their office, (2) a personal letter from individual voters, (3) phone calls and (4) email messages.

As your constituent, I urge you to vote YES on HR 5842 (the medical marijuana patient protection act). Sick people should have the right to the medicine their doctor recommends. States should have the right to govern such matters as they see fit. The will of voters in states which enact medical marijuana laws should NOT be overridden by the federal government. Please support the thousands of people who are simply asking our federal government to allow them the medicine their doctor believes is beneficial. In 1988, after reviewing all evidence brought forth in a lawsuit against the government's prohibition of medical marijuana, the DEA's own administrative law judge (Judge Francis Young) wrote: "The evidence in this record clearly shows that marijuana has been accepted as capable of relieving the distress of great numbers of very ill people, and doing so with safety under medical supervision. It would be unreasonable, arbitrary and capricious for the Drug Enforcement Administration to continue to stand between those sufferers and the benefits of this substance in light of the evidence." Judge Francis Young of the Drug Enforcement Administration went on to say: "Marijuana, in its natural form, is one of the safest therapeutically active substances known. In strict medical terms, marijuana is safer than many foods we commonly consume."

As your constituent, I urge you to vote YES on HR 5843,(act to: Remove Federal Penalties for the Personal Use of Marijuana by Responsible Adults). On March 22, 1972: The Richard Nixon-appointed, 13-member National Commission on Marijuana and Drug Abuse recommended the decriminalization of marijuana, concluding, "[Marijuana's] relative potential for harm to the vast majority of individual users and its actual impact on society does not justify a social policy designed to seek out and firmly punish those who use it."
